2.- PROCEDURE (criteria for measuring occupied spaces)
The way to measure spaces occupied by goods or vehicles will be determined by the rectangle circumscribed around the total consignment of goods or deposited elements, defined in such a way that two of its sides are parallel to the dock edge; the number of square metres will be rounded up in order to obtain an immediate figure free of decimals.
The procedure will be carried out in like fashion in sheds and warehouses, whose sides will serve as references.
Payment will be based on the surface occupied either at the end of discharge or immediately before starting loading, according to what is established in the previous norm.
In addition, for goods wagons/containers, occupancy can be measured by units of goods, with the resulting decrease in occupancy, notwithstanding the general norm regarding measurement of circumscribed rectangle.
The Port Authority, adhering to efficiency criteria in its management of the service and to operational rationality, can decide to count the surface either by consignments or by the whole cargo.
The surface will be reduced by quarters as the goods are withdrawn for payment, taking occupancy rate as the whole until 25% of the occupied surface has been cleared, 75% when withdrawal exceeds 25% but is less than 50%, 50% when 50% has been cleared but without reaching 75%, and 25% when 75% has been withdrawn, and until the whole of the occupied surface has been freed.
3.- DETERMINING RESERVED TIME
Storage will be counted from the day that has been reserved until the goods are collected and the surface is left free.
Cancellation or modification of a reservation less than 24 hours before its scheduled commencement, or if the reservation is not cancelled and the goods do not arrive at the Port, will give the Port Authority the right to charge the tariff applicable to the goods for the whole first day of the scheduled reservation, notwithstanding the fact that the space may be used by other goods.
4.- USER OBLIGATIONS
The goods will be deposited in the manner and stack height as determined by the Port Authority Management, in accordance with the current regulations: among other things, the necessary precautions to guarantee the safety of the piles and the load-bearing capacity of the esplanades will be observed.
In any case, for the effects of this tariff, a space can only be considered free, when it remains in the same states of maintenance and cleanliness as it was when occupied, and it is accessible and useful for other uses. Failure on behalf of the user to fulfil this obligation, after withdrawing goods and vehicles, will empower the Port Authority to carry out the above-mentioned maintenance and cleaning using its own means and charging the user the corresponding costs.
